Gasall App Terms of Use

  1. OWNERSHIP OF THE APPLICATION 
These terms govern access to and use of the Gasall mobile application and the features, content and services associated with it.  Gasall is owned by NUNSYS, S.A., with registered office at Calle Gustave Eiffel 3, 46980 Parque Tecnológico de Paterna (Valencia), Spain, and Spanish Tax Identification Number (NIF) A-97929566.  Hereinafter, NUNSYS, S.A. may also be referred to as “Gasall”, “we”, “us” or “the application owner”, without this affecting the legal ownership of the application or its associated services. 
  1. ACCEPTANCE OF THE TERMS 
By downloading, installing, accessing or using Gasall, the user accepts these terms of use. If the user does not agree to them, they must refrain from using the application.   Where certain features require registration, purchase, subscription, express acceptance or an additional agreement, specific terms may apply and will prevail over these general terms to the extent of any inconsistency.  Gasall may request express acceptance of these terms by means of a checkbox, acceptance button, welcome screen, registration flow, purchase process or equivalent mechanism. 
  1. WHAT GASALL IS 
Gasall is an application that allows users to consult information relating to service stations in Spain, including, among other things, location, distance, opening hours, fuel prices, routes, favourites, preferences, discounts, promotions, price history, refuelling estimates and other information useful for planning journeys.  Gasall acts as a technological and informational tool to help users decide where, when and how to refuel. Gasall does not sell fuel, operate service stations or set fuel prices.   Gasall does not act as an intermediary, agent, representative, commission agent or party to the sale and purchase of fuel or to the procurement of services offered by service stations or third parties. Any purchase, refuelling transaction, payment, commercial complaint, product availability, payment method, access, queue, ancillary service or specific condition must be verified and, where applicable, handled directly with the relevant service station or third party.   These terms are intended for end users of the app. Use by owners, managers or representatives of service stations, advertisers or professional third parties may be subject to specific terms, service agreements or separate CMS terms.  
  1. RESPONSIBLE USE AND ROAD SAFETY 
The user undertakes to use Gasall responsibly, lawfully and safely.  It is expressly prohibited to use the application in any way that could compromise road safety. The user must configure the application, consult routes, change filters, review prices or interact with any feature only when the vehicle is safely stopped or with the assistance of another person who is not driving.   Gasall is not a substitute for the driver’s attention, traffic regulations, road signs, instructions from the authorities or the user’s reasonable judgement while driving.  Any route, distance, estimated time, access or travel recommendations displayed in the application are for guidance only and may depend on third-party services, signal availability, device configuration, traffic conditions, roadworks, closures, restrictions, weather conditions or other factors beyond Gasall’s control.  To use certain location-based features, the user must enable the relevant permissions on their device. Geolocation may not be fully accurate, and the user may change or disable these permissions in the device settings, which may limit or prevent some  
  1. AVAILABILITY OF THE APPLICATION 
Gasall is provided as it exists from time to time and subject to availability.  Although we make reasonable efforts to keep the application operational, secure and up to date, we do not guarantee that the service will be uninterrupted, error-free, free from technical incidents or compatible with all devices, operating systems, vehicles, screens, browsers, versions or third-party integrations.  We may modify, suspend, restrict or discontinue all or part of Gasall’s features for technical, legal, security, maintenance or product-development reasons, due to changes in suppliers or regulations, or as a result of commercial decisions.  The download, installation, updating and use of Gasall through app stores, operating systems, device manufacturers, map or navigation services, or other third parties may also be subject to their own terms, policies and technical or commercial decisions. Gasall does not control the availability of the application on those platforms or any reviews, blocks, restrictions, removals, version changes or requirements imposed by them.  
  1. FUEL PRICE INFORMATION 
Fuel prices displayed in Gasall come from external sources, third-party APIs, data reported by service stations, public sources or other information providers.  Gasall does not set, change or independently verify the final prices charged by service stations. The information is provided solely for guidance and information purposes.   Prices may not be updated in real time and may contain errors, delays, discrepancies, omissions or differences from the price ultimately charged at the pump or communicated by the service station.  Before refuelling or making any financial decision, the user must always verify the final price, applicable terms, fuel availability, opening hours, applicable discounts and any other relevant information directly with the service station.  Gasall will not be liable for price discrepancies, refuelling decisions, journeys made, additional costs, lost opportunities, expected savings not achieved or any consequence arising from the use of prices or estimates displayed in the application, except where such liability cannot legally be excluded. 
  1. ESTIMATES, DISCOUNTS, PRICE HISTORY AND CALCULATORS 
Discount, price-history, route, favourites, consumption, refuelling calculation, estimated cost, final price and potential savings features are provided for guidance only.  Results depend on data entered by the user, information available at the relevant time, technical parameters, external sources, route conditions, reported prices, estimated consumption, fuel type, configured discounts and other factors that may vary.  Gasall does not guarantee that estimates will match the actual cost of travel, refuelling, consumption, discounts or savings obtained.  Listings, rankings, filters, sorting, featured stations, suggestions, recommendations or preferred results displayed in Gasall may depend, among other factors, on the user’s location, distance, price, fuel type, opening hours, available data, selected filters, preferences, technical criteria, information availability, promotions, sponsorships or commercial agreements, where applicable. Their appearance or position does not guarantee that a station is objectively the cheapest, closest, most convenient or most suitable option for the user.  
  1. PROMOTIONS, IMAGES AND SERVICE-STATION CONTENT 
Certain service stations, operators, advertisers or third parties may publish, provide or request the publication of promotions, images, trademarks, logos, text, prices, services, benefits, campaigns, discounts, opening hours or other content visible in Gasall.  Such content is the sole responsibility of the third party that provides or publishes it. Gasall does not guarantee its accuracy, currency, legality, availability, fulfilment, commercial terms or suitability for the user’s expectations.   The appearance in Gasall of a promotion, image, badge, featured content, recommended station or commercial communication does not necessarily mean that Gasall endorses, guarantees, certifies or assumes responsibility for the offer, product, service or conduct of that station or third party.  Before making a decision, the user must verify directly with the service station the terms of any promotion, discount, service, availability, price, opening hours, restriction or benefit.  Gasall may review, moderate, remove, disable, restrict or cease displaying third-party content where it considers that the content may be unlawful, misleading, inaccurate, contrary to these terms, harmful to users or third parties, or detrimental to the application’s image, security or operation. 
  1. ADVERTISING AND SPONSORED CONTENT 
Gasall may display advertising, promotions, sponsored content, featured stations, commercial communications, campaigns or similar formats within the application.  Where appropriate, such content may be identified as advertising, sponsorship, promotion, featured content or by equivalent wording.  The presence of advertising or sponsored content does not mean that Gasall personally recommends the product, service, station, advertiser or promotion, or guarantees its terms, availability, quality, price or fulfilment.  Advertisers and third parties are responsible for the truthfulness, legality and suitability of their advertisements, promotions, images, trademarks, prices, discounts and content.  The processing of personal data, advertising identifiers, preferences, campaign measurement, cookies, SDKs or similar technologies will be governed by the Privacy Policy and, where applicable, the Cookie Policy or the relevant consent panels. 
  1. USER ACCOUNTS AND FUTURE FEATURES 
Some Gasall features can currently be used without creating a user account. However, Gasall may introduce user accounts, profiles, synchronisation between devices, purchases, subscriptions, personalised benefits, management of favourites, history, alerts, communications, user participation or other features in the future.   Where registration is available, the user must provide truthful, current and complete information, keep their credentials secure and not permit unauthorised third parties to use their account.  The user will be responsible for activity carried out through their account, except for unauthorised use not attributable to the user. The user must notify Gasall of any suspected unauthorised access, impersonation, loss of credentials or unauthorised use.   Gasall may suspend or cancel accounts in the event of a breach of these terms, fraudulent use, security risk, unlawful activity, data manipulation, harm to third parties or use contrary to good faith. 
  1. IN-APP PURCHASES, SUBSCRIPTIONS AND PAID SERVICES 
Gasall may offer free features and paid features, including in-app purchases, advertising removal, subscriptions, premium services or other arrangements.  Before the user purchases any paid feature, they will be informed of the applicable essential terms, including price, taxes, duration, renewal, payment method, included features and, where applicable, cancellation terms.  Where a purchase is made through the App Store, Google Play or another distribution platform, payment, billing, renewal, cancellation, refunds and purchase management may also be subject to that platform’s terms.  Unless otherwise stated, the removal of advertising or other paid features will not necessarily affect informational content, service-station promotions, communications from Gasall itself, technical notices, operational messages or content that is not considered removable advertising.  Where legally applicable, a consumer user may exercise the right of withdrawal under the terms established by consumer-protection legislation. However, this right may not apply or may be lost in the circumstances provided by law, including, among others, the supply of digital content or digital services where performance has begun with the user’s prior consent and acknowledgement that they may thereby lose the right of withdrawal.   For purchases managed by the App Store, Google Play or other platforms, requests for cancellation, refunds, renewal or termination must, where appropriate, be processed through the mechanisms provided by the relevant platform, without prejudice to any rights the user may legally have against Gasall.  The user’s statutory consumer rights are not limited by these terms. 
  1. NOTIFICATIONS AND COMMUNICATIONS 
Gasall may send operational, technical or functional communications relating to the application, such as notices about significant changes, incidents, updates, features, security, favourite stations, alerts or useful information connected with the service.  Where communications are commercial or promotional in nature and consent is required by law, consent will be requested in accordance with applicable regulations. The user may disable notifications in the application or device settings where technically possible.  
  1. USER PARTICIPATION AND REPORT 
Gasall may allow users to submit comments, suggestions, notices, error reports, incident reports, incorrect prices, service-station information or any other communication.  The user undertakes to submit information that is truthful, provided in good faith, non-fraudulent, not manipulated and does not infringe third-party rights.  Submitting false, abusive, automated, malicious or bulk reports, unauthorised commercial communications, or reports intended to improperly alter the information displayed in the application or harm service stations, users, competitors or third parties is prohibited.  Gasall may review, disregard, restrict, remove or block reports or communications where there are indications of abuse, fraud, error, automation, manipulation or breach of these terms. 
  1. REPORTING UNLAWFUL OR MISLEADING CONTENT 
If the user believes that a promotion, image, advertisement, service-station content, displayed data or communication visible in Gasall is unlawful, misleading, infringes third-party rights or breaches these terms, they may report it through the contact channel made available by Gasall in the application, on its website or in these terms.  To the extent possible, the report must identify the content, affected station or advertiser, the reason for the complaint and a means of contact.  Gasall may assess the report, request additional information, remove or restrict the affected content, leave it published where no breach is found, or take any reasonable and proportionate measure appropriate to the circumstances.  When Gasall takes measures to moderate, remove, restrict, block or disable content, reports, accounts or features, it will endeavour to act reasonably and proportionately, taking into account the available information, seriousness of the breach, recurrence, potential harm to users or third parties and applicable legal obligations.  Receipt of a report does not create an automatic obligation to remove the reported content. Gasall may assess each case and, where appropriate, provide a reasonable channel through which the affected user or third party may submit clarifications or representations or request a review of the measure taken.  
  1. PROHIBITED USE OF THE APPLICATION 
The user may not use Gasall for unlawful, fraudulent or misleading purposes or in a manner contrary to good faith; manipulate prices, reports, discounts, stations, routes, reviews, data or features; introduce viruses, malware or malicious code or attack the application; scrape, carry out bulk extraction, systematically copy, mine data or reuse content without authorisation; access or attempt to access restricted systems, accounts, data or areas without authorisation; decompile, reverse engineer or modify the application except where permitted by law; use bots, scripts, automation or unauthorised mechanisms; infringe intellectual property, industrial property, image, honour, privacy or any other third-party rights; or use Gasall in a manner that harms its security, stability, reputation, pe 
  1. INTELLECTUAL AND INDUSTRIAL PROPERTY 
Gasall, its software, design, code, structure, trademarks, logos, text, interfaces, databases, features, proprietary content and other protectable elements are owned by Gasall or third-party licensors.  Use of the application does not grant the user any ownership rights in Gasall or its content, except for a limited, revocable, non-exclusive, non-sublicensable and non-transferable licence to use the application for personal, lawful and non-commercial purposes in accordance with these terms.  Unless expressly authorised by Gasall or permitted by applicable law, the user may not copy, reproduce, distribute, transform, communicate publicly, rent, sell, sublicense, commercially exploit, extract, systematically reuse, create derivative databases from, reverse engineer, decompile or use the application, its content or data to develop competing services or  The trademarks, logos, trade names, images or content of service stations, advertisers or third parties belong to their respective owners. 
  1. THIRD-PARTY LINKS, MAPS, NAVIGATION AND INTEGRATIONS 
Gasall may include links, maps, operating systems, app stores, navigation services, analytics tools, data providers, payment gateways, APIs, SDKs or third-party integrations.  Gasall does not necessarily control those services or their terms, availability, accuracy, security, policies, content or operation.  Use of third-party services may be subject to their own legal terms and privacy policies. 
  1. DATA PROTECTION 
The processing of personal data arising from the use of Gasall is governed by the Privacy Policy in force from time to time.  These terms of use do not replace the Privacy Policy or any consents, panels, permissions or settings that may be required for location, analytics, advertising, notifications or other features.  For any data-protection matter, the user may use the channels stated in the Privacy Policy or those made available by the application owner from time to time. 
  1. MINORS 
The application is intended for the general public. Where the user is a minor, Gasall must be used with the authorisation or supervision of their legal representatives where required by applicable law.   Paid features, subscriptions or premium services must be purchased by persons with sufficient legal capacity or with the involvement of their legal representatives. 
  1. LIMITATION OF LIABILITY 
Gasall will not be liable for damages, losses, costs, incidents or harm arising from improper or unsafe use or use contrary to these terms; decisions made by the user on the basis of information provided solely for guidance; discrepancies in prices, promotions, opening hours, fuel availability or service-station services; content, offers, images, advertisements or promotions provided by third parties; failures of connections, devices, operating systems, app stores or third-party services; interruptions, errors, maintenance, changes or unavailability of the application; or use of the application while driving or in breach of road-safety rules.  The foregoing applies to the fullest extent permitted by law and does not exclude or limit any non-waivable consumer rights or any liability that cannot legally be excluded. 
  1. CHANGES TO THE TERMS 
Gasall may amend these terms to reflect legal, technical, functional, commercial, security or product changes.  Where changes are significant, Gasall will endeavour to communicate them through the application, website, email, app store or another reasonable means.  Use of Gasall after the new terms enter into force constitutes acceptance of them, without prejudice to any rights the user may have under applicable law.  Gasall may identify these terms by the date of the latest update, version number or another equivalent mechanism. The current version will be available through the application, website or channel made available by Gasall from time to time.  
  1. TERMINATION 
The user may stop using Gasall and uninstall the application from their device at any time.  Gasall may suspend, restrict or terminate the user’s access in the event of a breach of these terms, unlawful use, fraud, security risk, data manipulation, abusive use, harm to third parties or a legal requirement.  Termination will not affect obligations or liabilities arising before termination or any provisions that by their nature are intended to survive. 
  1. GOVERNING LAW AND DISPUTE RESOLUTION 
These terms are governed by Spanish law  Where the user is a consumer, any dispute will be submitted to the courts with jurisdiction under applicable law.  Where the user acts as a business or professional and a choice-of-court agreement is permitted by law, the parties may submit to the courts of Valencia, unless another mandatory venue applies by law.  Consumer users may submit complaints through the customer-service channels made available by Gasall and may also, where appropriate, contact public consumer authorities, alternative dispute-resolution systems or other legally established mechanisms. These terms do not limit any non-waivable consumer rights.   Where Gasall offers electronic contracting to consumers and the relevant requirements apply, it may provide information on available out-of-court dispute-resolution mechanisms in accordance with applicable regulations.  The user may contact Gasall at info@gasall.com regarding any complaint, incident or query relating to the applicatio
